Collihort Terms of Service

This page is Collihort’s product copy for clickwrap. It is not legal advice and is not a substitute for a Florida lawyer who drafts recreational, volunteer, and premises forms.

Who Collihort is

Collihort provides software and hosting so a neighborhood garden club can run its own site. Collihort is not a garden club, not a landowner, not an insurer, and not the operator of any plot, HOA common area, rooftop, or farm.

Each live garden site is a separate tenant. Organizers of that tenant run membership, chores, money, events, and land rules. Collihort staff are not on site in St. Augustine or anywhere else unless a written services contract says otherwise.

Software is not the club

Approving a community request, creating a solo garden, or pointing a custom domain at Collihort does not copy Palencia Collaborative Garden Club’s members, books, waiver signatures, receipts, or directory into the new site.

Each tenant stores its own records, including its own waiver forms. Palencia’s default clauses are a template other gardens may start from. They are not Palencia’s signed members and they are not a franchise of Palencia.

If someone is injured, cited, or sued over land, tools, food, animals, or neighbor disputes at a garden, that claim is between those people, that club, and that landowner — not a claim that Collihort operated the garden.

Accounts and acceptable use

You must give accurate contact information and keep your password to yourself. Organizers may approve, decline, or remove members on their tenant.

You may not scrape Find a garden listings to build another directory, post someone else’s phone number or street address they did not put in the club directory, attempt to break into another tenant, or use the service to harass neighbors.

Collihort may suspend a site or account that breaks these rules, that we are required to take down, or that we cannot reasonably host.

Content, outages, and data

Posts, photos, receipts, and directory fields are the club’s and the members’. Collihort hosts them so the club can function. We do not promise uninterrupted service, perfect backups, or that a post will stay online forever.

Organizers can export club records from Backup on a community site. If you leave Collihort, export first. We may delete a tenant after a long unpaid or abandoned period as described in operations notices we send to the organizer email on file.

Limitation of liability

To the fullest extent Florida law allows, Collihort is not liable for land injuries, crop loss, foodborne illness, animal incidents, HOA disputes, lost volunteer hours, or decisions organizers make about plots and money.

For claims about the software itself (outages, lost posts, failed emails, bugs), Collihort’s liability is limited to the fees you paid Collihort for the software in the twelve months before the claim, or one hundred US dollars if you paid nothing.

This section does not limit liability that Florida law says cannot be limited, including where a statute requires otherwise.

No employment or class-arbitration overlay

These Terms are for using garden-club software. They are not an employment agreement. Collihort members, organizers, and visitors are not Collihort employees by using the site.

These Terms do not appoint garden members as third-party beneficiaries of Collihort vendor contracts, and they do not import employment arbitration, JAMS employment rules, or similar workplace dispute programs.

Governing law

Florida law governs these Terms, without regard to conflict-of-law rules that would send the dispute elsewhere. Courts in Florida have exclusive venue for disputes about the software, except where a statute requires another forum.

Club membership and land-activity waivers are separate agreements with that garden club. They may name Florida recreational and premises rules. They do not make Collihort the garden operator.

Changes

The current Terms version is 2026-09-01. We may update this page. Continued use after we post a new version, or a new checkbox when we ask for it, is how you accept the update.
