Two agreements, not one footer
Collihort Terms and Privacy cover the software. This garden’s membership and activity agreement covers land, tools, animals, food, volunteer chores, and how this club uses photos, the directory, and receipts.
Request to join requires you to accept both. Signing a PIN or work-day waiver later is the club’s way of collecting a dated signature before you work. Organizers should not turn the library module off and assume the waiver registry disappeared — the registry stays with club operations, not the library.
Template, not Palencia’s signed club
If this garden has not published its own form yet, the clauses below are Collihort’s starter text, filled with this garden’s name. They are not a copy of Palencia Collaborative Garden Club’s signed members. A Florida lawyer should review them for this land and this HOA.
Activities this covers
This agreement covers all Palencia Collaborative Garden Club activities: working on club or privately owned land and garden plots; planting, weeding, pruning, composting, irrigation and harvesting; using hand and powered tools; handling and caring for animals including chickens, bees, and cattle; craft and food-processing workshops; work days, events, deliveries, and transport to and from club sites.
Assumption of risk on the land
Club sites are working agricultural ground, not maintained public parks. I understand there are uneven surfaces, ditches, mud, standing water, fencing, wire, thorns, falling limbs, farm vehicles, biting and stinging insects, snakes and wildlife, poisonous plants, Florida heat and lightning, and the possibility of severe injury or death. I take part voluntarily with full knowledge of these risks.
Animals
I understand that poultry, bees, livestock, and guardian animals are unpredictable and may peck, sting, bite, kick, or crush. I will follow the handler's instructions and biosecurity rules, will not enter enclosures without permission, and accept the risk of allergic reaction — including anaphylaxis from bee or wasp stings — and of zoonotic illness such as salmonella. I will wash and sanitize before leaving a site.
Plants, soil, and chemicals
I may be exposed to compost, manure, soil-borne organisms, pollen, sap, fertilizers, and approved pest or weed treatments. I will read labels, use the protective equipment provided, keep treated areas posted, and never apply any product to club plots without organizer approval.
Tools, equipment, and vehicles
I will only operate tools, mowers, tillers, chainsaws, carts, trailers, or vehicles I have been trained and cleared on by an organizer. I will use the required guards and protective gear, will not operate anything under the influence of alcohol, drugs, or impairing medication, and will not allow anyone under 16 to operate powered equipment or drive club vehicles. If I drive on club business I carry valid insurance and a valid driver's license.
Driver's license or government ID
I will present a valid, unexpired government-issued photo ID or driver's license whose full legal name and address match what I enter on this form. If my license or address changes, I will update it with the club and sign a current waiver. The club records only the issuing state, expiration date, and last four characters of the ID for verification — never the full number.
Food, produce, and homemade goods
Produce, eggs, honey, meat, preserves, soaps, and other goods from the club are homegrown or homemade, are not inspected or FDA-evaluated, and may not be commercially processed. I consume and use them at my own risk and will patch-test skin products.
Volunteer status, not employment
Chores, work days, harvests, and other club tasks are volunteer contributions to Palencia Collaborative Garden Club. I am not an employee, contractor, or agent of the club or of Collihort by joining or by doing those tasks. Nothing in this agreement creates wages, workers’ compensation coverage, or an employment relationship.
Release of liability
To the fullest extent allowed by Florida law, I release, waive, and hold harmless Collihort, the software vendor that hosts collihort.com and tenant garden sites (for software and hosting only, not as a land operator), Palencia Collaborative Garden Club, its organizers, hosts, moderators, volunteers, and any owner or lessor of land the club uses, from all claims for injury, illness, death, or property loss arising from my participation, except for gross negligence or willful misconduct. Fellow garden members are not released parties unless a lawyer for this club later names them.
Responsibility for guests and minors
I am responsible for anyone I bring. Minors must be directly supervised by their own parent or guardian at all times, may not handle powered equipment, lye, hot fat, or open hives, and are covered by this same agreement, which I sign on their behalf.
Medical consent
I consent to emergency medical treatment if I am unable to consent at the time, and I am responsible for any resulting medical costs. I will disclose allergies (including insect sting allergies) or conditions relevant to my safety to the organizer on site, and I will carry any rescue medication I need.
Directory, photos, receipts, and property
I will follow club rules, posted site rules, and organizer instructions, and understand my participation may be ended for unsafe behavior. Photos taken at club activities may be used in club communications unless I tell an organizer otherwise. Approved members can see the club directory, including the street and skills I provide on join, and can see receipts organizers publish in the club money records. I am responsible for damage I cause to club, neighbor, or private property through misuse or negligence.
Term and electronic signature
This agreement covers the activity date listed and continues for all club activities during the current season unless revoked in writing. I agree that typing my name is my legal electronic signature, and that this record is stored by the club and visible to signed-in club members in the waiver registry (contact details and ID data are shown only to organizers).
